Platforms Prohibited from Using Big Data to Charge Higher Prices to Regular Customers; "Measures for the Supervision and Administration of Online Transaction Platform Rules" Issued
The State Administration for Market Regulation and the Cyberspace Administration of China have jointly issued the "Measures for the Supervision and Administration of Online Transaction Platform Rules." The Measures require platforms to include explicit information security provisions in their platform rules, specifying the specific standards for how merchants on the platform handle personal information, as well as the merchants' obligations regarding the online protection of minors. At the same time, the Measures stipulate that platform rules must not be used to impose unreasonable restrictions on the independent business operations of merchants on the platform, nor to charge unreasonable fees, penalties, or damages; nor may they use platform rules to exclude or restrict consumer rights, reduce or exempt themselves from liability, unreasonably increase consumer liability, engage in "price discrimination" based on big data, or unilaterally and arbitrarily alter platform rules when providing membership services in a manner that harms members’ rights and interests.
